The derivation nix-functional-tests is failing to build during nixos-rebuild switch --flake ...

This causes failures in derivations named nix, lazy-options.json, options.json, nixos-manual-html, nixos-configuration-reference-manpage, nixos-help, and others.

For me using nixpkgs overlay to replace all nix with the fork from DeterminateSystems fixes for me.
Assume the flake input with url https://flakehub.com/f/DeterminateSystems/nix-src/%2A is named as detsys-nix, using

  nixpkgs.overlays = [
    (final: prev: { nix = inputs.detsys-nix.packages."${pkgs.stdenv.system}".default; })
  ];
}

instead of

{
  nix.package = inputs.detsys-nix.packages."${pkgs.stdenv.system}".default;
}

Pinning DeterminateSystems's nix to 3.16.3 to prevent updating it to 3.17.0 is also required for me:

nix flake update --override-input detsys-nix tarball+https://api.flakehub.com/f/pinned/DeterminateSystems/nix-src/3.16.3/019c8e13-4542-7edc-9244-38a597d18258/source.tar.gz

maybe there's a regression in their fork.
