<p class="font1">In May 2020, Blackbaud, a cloud software supplier, suffered a notable ransomware attack, and
shortly after discovering the breach, the company decided to pay the ransomware attackers, a move that was
deemed unwise by cybersecurity experts. Blackbaud is a publicly traded company on NASDAQ and considered a
leading cloud software provider for social good, serving over 25,000 organizations in over 60 countries. In
July 2020, the company posted a data breach notification on its website, stating that attackers had
exfiltrated and encrypted customer data the previous May. Blackbaud, as a data processor, was required to
notify the ICO and data control authorities within 72 hours of learning about the breach but failed to
respond promptly to requests for information about the affected customers, their identities, when they were
informed, and which ransomware strain or gang was involved. As a result, Blackbaud failed to meet GDPR
requirements to notify both regulators and data controllers (customers) of the breach. </p>
<p class="font1">IBlackbaud confirmed that it paid the ransom but did not disclose the amount. While there is no
law prohibiting companies from paying ransomware, cybersecurity experts do not recommend it as it could
encourage this type of illicit activity. Moreover, the trustworthiness of the criminals in such situations
is often questionable, and the sensitive data may still be vulnerable to misuse or public dissemination even
after the ransom is paid. In December 2020, a class-action lawsuit was filed against Blackbaud, claiming
that the company had incompetently secured its systems and failed to implement adequate and reasonable
measures to protect the personal and protected health information of its customers. The lawsuit also alleges
that Blackbaud failed to prevent or detect the breach promptly, failed to identify all accessed information,
failed to train its employees regarding ransomware attacks, and failed to provide any redress for the data
breach.</p>
