Legal Disclaimer & Terms of Use

ReconMaster is an open-source security research tool. This document outlines the legal terms, disclaimers, and responsible use guidelines.

⚠️ CRITICAL DISCLAIMER

ReconMaster is designed EXCLUSIVELY for authorized security assessments. Unauthorized access to computer systems is ILLEGAL and subject to severe criminal penalties.

Intended Use

ReconMaster may only be used for:

  1. Authorized Security Testing

    • Testing systems you own
    • Testing systems with explicit written authorization from the owner
    • Authorized bug bounty programs
    • Authorized penetration testing engagements
    • Security research in controlled environments

  2. Legitimate Activities

    • Vulnerability research
    • Security training and education
    • Compliance testing
    • Security auditing
    • Academic research (with IRB approval)

Prohibited Uses

ReconMaster MUST NOT be used for:

  1. Unauthorized Access

    • Accessing systems without explicit permission
    • Testing systems you don't own or have authorization for
    • Gathering competitive intelligence illegally
    • Wiretapping, eavesdropping, or surveillance
    • Identity theft or fraud

  2. Malicious Activities

    • Disruption of services or systems
    • Data theft or exfiltration
    • Installation of malware or backdoors
    • Denial of service attacks
    • Extortion or blackmail
    • Circumventing security controls

  3. Illegal Purposes

    • Any activity violating applicable laws
    • Targeting critical infrastructure
    • Privacy violations
    • Copyright/intellectual property infringement

Applicable Laws & Regulations

Users are responsible for compliance with all applicable laws:

United States

  • Computer Fraud and Abuse Act (CFAA) - 18 U.S.C. § 1030

    • Unauthorized access: up to 10 years imprisonment, $250,000 fines
    • Reckless endangerment: up to 20 years imprisonment
    • Extortion/blackmail: additional penalties

  • Digital Millennium Copyright Act (DMCA) - 17 U.S.C. § 1201

    • Anti-circumvention provisions may apply to some uses

  • National Computer Security Center (NCSC) Guidelines

    • Various agency-specific regulations

European Union

  • GDPR (General Data Protection Regulation)

    • Consent requirements for data processing
    • Right to be forgotten
    • Data breach notifications
    • Fines up to €20 million or 4% of turnover

  • Computer Misuse Act (UK) - Computer Misuse Act 1990

    • Unauthorized access: up to 2 years imprisonment
    • Unauthorized modification: up to 5 years imprisonment
    • With intent to commit/facilitate crime: up to 10 years

  • French Penal Code - Articles 323-1 to 323-7

  • German StGB (Strafgesetzbuch) - § 202a, § 263a

Other Jurisdictions

  • Similar computer fraud/access laws in most countries
  • Telecommunications regulations (India ITA, 2000)
  • Privacy laws (Australia Privacy Act, Canada PIPEDA)

Limitation of Liability

THE AUTHORS AND COPYRIGHT HOLDERS OF RECONMASTER PROVIDE THIS SOFTWARE "AS IS" WITHOUT WARRANTY OF ANY KIND, either express or implied, including but not limited to:

  1. NO WARRANTY

    • No warranty of merchantability
    • No warranty of fitness for particular purpose
    • No warranty of non-infringement

  2. NO LIABILITY FOR

    • Direct, indirect, incidental damages
    • Consequential or special damages
    • Lost profits, revenue, or data
    • Business interruption
    • Reputational harm
    • Any damages whatsoever

  3. USER ASSUMES ALL RISK

    • Use of this software
    • Results of using this software
    • Any data loss or system damage
    • Legal consequences of misuse

Indemnification

Users agree to indemnify, defend, and hold harmless the authors and copyright holders from any and all:

  • Claims, damages, and costs
  • Litigation expenses
  • Attorney fees
  • Third-party claims
  • Regulatory enforcement actions

...arising from the user's use or misuse of ReconMaster.

Responsible Disclosure

If you discover security vulnerabilities:

  1. Do NOT publicly disclose until patched
  2. DO report privately to: security@example.com
  3. Allow 90 days for patch development
  4. Verify with updated version before public disclosure

Compliance with Bug Bounty Programs

When using ReconMaster in authorized bug bounty programs:

  1. Review Program Rules

    • Understand scope limitations
    • Respect test schedule windows
    • Follow testing methodologies specified

  2. Proper Authorization

    • Only test within defined scope
    • Keep testing credentials/keys secure
    • Report findings through official channels

  3. Ethical Conduct

    • Do not access more data than necessary
    • Do not modify or delete data
    • Do not disrupt services
    • Do not share vulnerabilities with others

Academic & Research Use

For academic/research purposes:

  1. Institutional Review

    • Obtain IRB/ethics board approval for human subject research
    • Follow institutional policies
    • Use controlled/test environments only

  2. Responsible Research

    • Coordinate disclosure with affected organizations
    • Publish findings responsibly
    • Provide remediation timeline

Penalties for Misuse

Violations may result in:

  • Criminal Penalties

    • Imprisonment: 2-20+ years
    • Fines: $10,000 - $250,000+
    • Multiple counts possible

  • Civil Liability

    • Damages: Actual + Treble (3x)
    • Attorney fees and court costs
    • Injunctions/restraining orders

  • Professional Consequences

    • Loss of certifications
    • Employment termination
    • Industry bans
    • Professional license revocation

Reporting Misuse

To report suspected misuse of ReconMaster:

  • Report to law enforcement (FBI, local police)
  • Contact the affected organization
  • Report to GitHub: abuse@github.com

By downloading, installing, or using ReconMaster, you acknowledge that you:

  • Have read this legal disclaimer
  • Understand the legal risks
  • Will only use ReconMaster for authorized, lawful purposes
  • Accept all liability for your actions
  • Understand the authors assume no responsibility for misuse

Modifications to Terms

The authors reserve the right to modify these terms at any time. Continued use constitutes acceptance of modifications.
