Sourcemeta welcomes and appreciates external contributions, whether code, documentation, design, or any other type of improvement to our projects.
Sourcemeta projects are dual licensed. Anyone may use them under their open-source license, typically the GNU Affero General Public License v3.0. By contributing, you keep your copyright and grant Sourcemeta OÜ the licenses below. As the only party holding these licenses from every contributor, Sourcemeta alone can offer the projects under other terms, including by selling exceptions to the open-source license. That is how Sourcemeta funds its open-source work.
A contribution is any original work of authorship, including modifications or
additions to an existing work, that you intentionally submit for inclusion in
any project that Sourcemeta publishes under an open-source license from a
source code repository it administers, such as those under the sourcemeta
GitHub organization. Submitting covers any
electronic or written communication sent to Sourcemeta for that purpose, such
as pull requests, patches, and code or documentation proposed in reviews or
issue trackers, but excludes anything you conspicuously mark as "Not a
Contribution". Anything else, such as using or forking a project, creating
derivative works, or filing issues, is governed solely by the license of the
corresponding project, and this document imposes no terms on it.
Every Sourcemeta project enforces the Developer Certificate of Origin
(DCO), a statement introduced by the Linux
Foundation to ensure the contributor is allowed to make the contribution and
that the project may distribute it under its license. It requires you to
sign off your Git commits, which you can do with the
--signoff
command-line flag.
Signing off a commit has two cumulative effects: you certify the Developer Certificate of Origin and you accept the Contribution License below for the corresponding contribution. The Contribution License is in addition to, and independent of, the Developer Certificate of Origin and the project license, and prevails over both as to the rights you grant to Sourcemeta.
These terms are an agreement between you and Sourcemeta OÜ, a private limited company registered in Estonia under registry code 17180733 ("Sourcemeta"). Except for the licenses granted below, you retain all right, title, and interest in your contributions.
"You" means the individual or legal entity accepting these terms, and for a legal entity includes any entity that controls it, is controlled by it, or is under common control with it, meaning owning more than half of the voting interests or directing management. If you accept on behalf of a legal entity, you represent that you have authority to bind it. If your contributions are owned by your employer or another entity, that entity must accept these terms through someone authorized to bind it, and you will ensure that any entity owning rights in your contributions accepts these terms or grants Sourcemeta the same licenses. You represent that you have full legal capacity to accept these terms.
You accept these terms by signing off a commit that forms part of a contribution, or by stating your acceptance in a format that can be reproduced in writing, such as a pull request, issue, or e-mail message, and Sourcemeta may request that statement before merging a contribution. In any case, by intentionally submitting a contribution while these terms are published in the repository of the corresponding project, or in an organization-wide repository such as this one that the source code hosting platform displays for that project, you accept them for that contribution, even if the submission carries no sign-off or statement. If your submission carries no sign-off or statement, Sourcemeta will point you to these terms before merging it, and you may withdraw the submission instead. If, despite the above, these terms are not validly accepted for a submission, it is licensed by you, to the extent of your rights in it, to Sourcemeta and all recipients of it under the open-source license of the corresponding project. No further act by Sourcemeta is required.
The version of these terms published in this repository when you submit governs that contribution, with the Git history of this file as the authoritative record and each contribution identified by its version control record. By accepting these terms through a sign-off or statement, you also accept them for, and they then govern, every contribution you previously submitted while Sourcemeta administered the corresponding project, in addition to, and without limiting or revoking, any license previously granted to any person, unless you exclude past contributions by notifying Sourcemeta, in a format that can be reproduced in writing, when you accept these terms.
You grant Sourcemeta a worldwide, non-exclusive, no-charge, royalty-free, and irrevocable copyright license, for the entire duration of the copyright, transferable in the circumstances described in the General section and sublicensable through multiple tiers, to use, reproduce, translate, adapt, arrange and otherwise modify, prepare derivative works of, include in collections, publicly display, publicly perform, distribute, communicate to the public, and make available to the public your contributions and such derivative works, in any medium, to otherwise exercise all economic rights in them, and to license them, alone or as part of a project, under any open-source license and under any proprietary or commercial terms, including by selling exceptions to the open-source license of the corresponding project. This license covers only material in which you own the rights or are otherwise entitled to license. Third-party material is addressed below.
You grant Sourcemeta, together with all direct and indirect recipients and users of your contributions or of software incorporating them that is distributed or made available by Sourcemeta, its licensees, or its sublicensees, including users interacting with such software remotely through a computer network, a worldwide, non-exclusive, no-charge, royalty-free, and irrevocable (except as stated in this section) patent license, for the entire term of the applicable patent claims, to make, have made, use, offer to sell, sell, import, and otherwise transfer your contributions, covering only those patent claims licensable by you that are necessarily infringed by your contributions alone or in combination with the project to which they were submitted. If any entity institutes patent litigation, including a cross-claim or counterclaim in a lawsuit, alleging that your contribution, or the project to which you contributed, constitutes direct or contributory patent infringement, the patent licenses granted to that entity under these terms for that contribution or project terminate as of the date such litigation is filed.
Sourcemeta will consider contributions in good faith and preserve authorship information as recorded in version control, but is under no obligation to accept, use, or continue distributing any contribution, where accepting means merging into a project repository. For as long as Sourcemeta distributes a version of a project that includes your contribution, it will keep that version available under an open-source license or a license that makes its complete source code publicly available.
You consent to Sourcemeta, its successors and assigns, its direct and indirect licensees and sublicensees, and the recipients and users of its software doing anything with your contributions that would otherwise infringe your moral rights, including modifying them, combining them with other works, disclosing them, and attributing them in a manner customary for software, such as version control history, notice files, or aggregated contributor lists, even without individual attribution where those means are impracticable. Where this consent is not effective under applicable law, you agree not to assert those rights against any of them. You retain your right to contest uses prejudicial to your honour or reputation.
To the extent permitted by applicable law, upon Sourcemeta's request you assign to it the monetary claims arising from third-party violations of the license of the project to which your contributions were submitted, and you authorize Sourcemeta to enforce the copyright in your contributions, in its own name or in yours, at its own expense. At Sourcemeta's request and expense, you will join proceedings where required for standing and reasonably cooperate in any such enforcement.
If any part of your submission is not your original creation, as the Developer Certificate of Origin permits, you must identify that part, its source, and its license in the commit message or in the submission itself, and its license must be compatible with the license of the corresponding project. Third-party material enters the project solely under its own license. The licenses granted under these terms do not cover it, and Sourcemeta will not rely on these terms to license it under any other terms.
You represent that you are legally entitled to grant the above licenses, and that, if your employer has rights to intellectual property you create, you have permission to contribute on its behalf or it has waived those rights for your contributions to Sourcemeta. You represent that each contribution is your original creation, except for third-party material identified as described above, where original creation refers to the material you author and submit, not the pre-existing code it modifies. You agree to notify Sourcemeta at the address below of anything that would make these representations inaccurate, and to reasonably assist Sourcemeta in replacing or relicensing affected material if they prove inaccurate.
You are not expected to provide support for your contributions. Unless required by applicable law or agreed to in writing, you provide them on an "AS IS" basis, without warranties or conditions of any kind, express or implied, including title, non-infringement, merchantability, or fitness for a particular purpose.
Sourcemeta may assign these terms, or transfer the licenses granted under them, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of assets, or to a successor maintainer of the corresponding project. These terms bind and benefit the parties and their successors and permitted assigns, and any assignment of these terms or transfer of the licenses granted under them remains subject to the Availability of Contributions section. If any provision is held unenforceable, the rest remains in effect. These terms do not deprive you of any statutory right that cannot be limited or waived by agreement, do not modify, limit, or condition any right that anyone has under the open-source license of any Sourcemeta project, and are not additional terms under section 7 of the GNU Affero General Public License or any similar provision of any other license.
These terms are the entire agreement regarding the contributions they govern and, as to the rights you grant to Sourcemeta, supersede any earlier contribution terms published by Sourcemeta. To the extent any earlier terms purported to assign the copyright in a contribution to Sourcemeta, Sourcemeta confirms that you own that contribution and that Sourcemeta holds rights in it solely as a licensee under these terms or under any terms you previously accepted for it.
